STANDARD TERMS AND CONDITIONS OF SUBSCRIPTION

 

 

 

  (a)        The Services shall be used through The Subscriber’s television connected with the Equipment. The Subscriber shall only use the Services for watching the channels and programmes in the Subscription Package in the territory of Myanmar;

 

(b) The Term of the Subscription (the”Term”) shall start from the Activation Date.

 

(c) Upon the expiry of the Term of the subscription, if The Subscriber fails to renew the subscription before its expiry date, the subscription shall automatically terminate on that expiry date.

 

            (d) If The Subscriber wants to renew the Services. The Subscriber may choose the Subscription for renewal among the available Subscriptions of CANAL+ Myanmar on the date of renewal. The Subscription price shall be the price applicable on the date of renewal. The terms and conditions provided herein (except for the renewal Subscription, its price and term) shall be applied for the renewed period.

 

            (e) The renewal term shall be start from (i) the expiry date of the current term in case the current term has not ended; or (ii) the date of renewal request in case The Subscriber renews the Subscription after the expiry date of the current term.

 

(f) Subject to the payment of the additional fees for the upgraded period, which is based on the price applicable provided by CANAL+ on the date of upgrading, during the Term or any renewal term (if any), The Subscriber may request to upgrade his current/previous Subsciption to the higher level of Subscription of CANAL+ Myanmar.   

 

 

(g) The Equipment Price and Subscription Fees shall not be refunded in case of the Services shall be stopped, terminated for the violation of the Contract by The Subscriber;

 

(h) If The Subscriber chooses to use an installation service, the installation fees shall be paid directly by The Subscriber to the installation service supplier.

 

(i) The Subscriber (Customer) shall :

 

 

  1. Ensure the usage of the Services/Subscription as stipulated herein;

 

  1. Be provided with explanations and instructions regarding the Subscription Fees and how to use the services;

 

  1. Only use the Equipment to watch channels in the Subscription in the territory of Myanmar;

 

  1. The Subscriber shall notify CANAL+ in writing for resolution in cases of change of customer name, address, upgrading of Subscription, or assignment of the right to use the Subscription;

 

  1. CANAL+ shall not be responsible in cases where the Equipment is not allowed to be installed or is forced to be dismantled because the Subscriber has not obtained the necessary approvals for installation of the Equipment at the Subscriber's site.

 

  1. Be responsible for checking the warranty seal, serial number of the Warranted Equipment in compliance with the specification.  

 

  1. The Subscriber shall only use the Equipment and Subscription for the individual purpose at home. The Subscriber shall not use or copy or sell the information or any of contents in the packages provided in the channels in the Subscription (registered to use by The Subscriber under this Contract), in whole or in part, for the purpose of business, re-broadcasting in the public areas, production, duplication, publication, publication on internet, re-broadcasting or distribution in whatsoever manner.

APPENDIX 1

WARRANTY OF EQUIPMENT

.

Brand-new decoders and smart cards ('Warranted Equipment') will be under warranty by CANAL+ from the date of purchase by the Subscriber, at no additional cost. The warranty period for the Warranted Equipment shall be twelve (12) months from the date of Warranted Equipment purchased by the The Subscriber provided that (i) the Warranted Equipment shall have been transported, installed and used properly as instructed by CANAL+, and (ii) the defects must arise due to manufacturer’s defects.

 

The warranty under the Contract shall not be applied in the following cases:

  1. The Warranted Equipment has been modified or repaired by the customer or any non-authorized person by CANAL+;
  2. Technical maintenance inside of the Warranted Equipment by the Subscriber and/ or a third party not approved by CANAL+;
  3. The Warranted Equipment has been tampered with or attempted to be repaired by the Subscriber or any others not authorized by CANAL+ to do so and which results in the Warranted Equipment being damaged;
  4. The warranty shall not cover activities of regular maintenance, conversion or replacement of the accessories due to normal wear and tear;
  5. Failure of Warranted Equipment due to accident, force majeure event, configuration change in comparison with the original provided by the manufacturer of the Warranted Equipment;
  6. Warranted Equipment are not provided by CANAL+/ CANAL+’s authorized agency;
  7. Misuse or use or installation of the Warranted Equipment contrary to the instruction manual for the Warranted Equipment;
  8. The “warranty seals” are not intact or the fake “warranty seals” are stuck on the set-top-box at the time of receipt of the same at the warranty center of CANAL+;
  9. The serial number of the Warranted Equipment has been removed or defaced;
  10. Improper conditions of storage (except in the case of storage by CANAL+ or one of its Retailer);
  11. Direct effects of strike light.

 

 

 

Data Protection:

Subscriber's personal data will be used in compliance with the Data Protection Act, solely for service provision, and not shared with third parties unless required by law or for necessary service-related purposes. Subscribers have rights to access, correct, and request deletion of their data.

 

Dispute Resolution:

For disputes arising from this Agreement, parties will first attempt resolution through negotiation, followed by mediation, and finally binding arbitration, if necessary, under the specified arbitration rules.

 

Termination Rights:

Either party may terminate the Agreement for material breach not remedied within 30 days, insolvency, bankruptcy, cessation of operations, or by mutual written agreement.

 

 

 

Service Availability:

CANAL+ targets a 99% monthly service uptime. Subscribers are entitled to credit for downtimes below 95%, excluding scheduled maintenance and events beyond CANAL+'s control.

 

Limitation of Liability:

CANAL+'s liability is limited to indirect damages and shall not exceed the total subscription fees paid by the Subscriber in the preceding 12 months, irrespective of the cause of the claim.
